Gift Voucher Terms and Conditions

You are purchasing gift vouchers from the Ommaroo Hotel, Havre des Pas, St Helier, Jersey, Channel Islands, JE24UL. Telephone contact: +44 (0) 1534 723493. Enquiries regarding the gift vouchers can be made by email to [email protected] and further information can be found at www.ommaroo.com.

Gift vouchers purchased can only be redeemed for goods and services provided by the Ommaroo Hotel as stipulated during the purchase. They have no cash value and no change will be given.

Your Data

By purchasing your Voucher on www.ommaroo.com, you are consenting to the collection, use and disclosure of your personal information to the Ommaroo Hotel for the purpose of the issue and redemption of your Voucher.

Processing your order

Gift vouchers ordered will be issued and dispatched within 48 hours (except weekends and Bank Holidays, when they will be issued and dispatched the following working day). Working days are Monday to Friday of any week excluding any public or bank holidays. If a gift voucher is ordered after 12 noon on a Friday, it will be issued and dispatched on the following Monday.

Payment for gift vouchers

For security reasons, you may only purchase gift vouchers using a credit or debit card which belongs to you and has sufficient funds to cover the cost of the vouchers you are purchasing. You must be 18 years or over to purchase gift vouchers. We reserve the right to cancel a Voucher if we believe that the card was obtained through fraudulent or unauthorized means. Any tax liability, including disclosure, connected with receipt or use of the voucher is the recipient’s responsibility.

Gift voucher purchases are only valid once you have paid for them in full and you receive email confirmation of the purchase. Please check this confirmation carefully as we may not be able to amend any issues at a later date.

With the exception of shipping fees, no service or use fees of any kind will be imposed on purchasers or recipients of vouchers in connection with the sale of the voucher.

Payment is using a 3rd party payment provider that is not associated with our website. We will not transmit any of your payment card details, you will be redirected to a secure payment page depending on the payment processor that the company chooses to work with.

Receiving your gift vouchers

At the time of purchase, you are asked to select method of delivery for your vouchers. You may choose collection of your voucher in person or by post. The following terms apply for these methods:

Collection of your voucher in person: there is no charge for this method. Please allow 48 hours for processing of this voucher purchase (please see ‘processing your order’ above) before collecting your voucher from the Ommaroo Hotel reception. You may be asked to show the credit or debit card with which the payment was made and you will be asked to sign for receipt of the vouchers.

Delivery by post: postage and packaging fees apply, which vary depending on location of delivery, but are clearly shown during your online purchase and included in the final price you are asked to pay. We endeavour to dispatch any postal gift vouchers within 48 hours of purchase, however we cannot guarantee this and take no responsibility for the delayed arrival of posted vouchers. In the unlikely event that a reasonable time has passed and your vouchers are deemed lost in the posting process, please contact us and we will arrange for replacement vouchers to be sent to you at no extra charge. Your original vouchers will be cancelled if replacement vouchers are issued in this instance.

Your right to cancel your online order

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (which came into force on 13 June 2014 and applies to contracts entered into on or after that date) gives you the right to cancel your online order. Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods. The right to cancel can be lost during the cancellation period if the service is provided in full before the 14 days elapses.

Your right to a refund

In the event of cancelling your order made online, we will refund you the price you paid for the voucher (including postage fee if paid) within 14 days of cancelling your order. This refund can only be applied to the credit or debit card used to make the original purchase.

You cannot cancel and request a refund for a voucher that has already been used.

Redeeming your vouchers

For security reasons, you cannot redeem or use a gift voucher within 72 hours of purchase, unless you have written confirmation and agreement of use by the Hotel’s management. Vouchers may be combined with other forms of payment, but no part or full refund will be given against unused amounts. No change will be given.

Voucher holders must mention the voucher number at the time of booking and present it on arrival at the hotel.

You must present your voucher to a member of hotel staff, as intended method of payment, prior to placing your order or on arrival to check in at the Hotel Reception.

Non-monetary gift vouchers have specific terms and conditions of use, which you will have agreed to when purchasing the gift vouchers online.  These may include specific products or services for which that voucher can be used for and any specific expiry dates. Some vouchers, in particular those relating to accommodation are subject to availability at the time of booking and we therefore strongly recommend that you book as early as possible to avoid disappointment. Bookings which will be paid for using gift vouchers can only be made directly with our Reservations Team by email to [email protected] or T. +44 (0) 1534 723493. We will use all reasonable endeavours to meet your requirements but cannot guarantee any specific dates or times prior to making your booking directly with Reservations and receipt of written confirmation accordingly.

Cancelling or amending gift voucher bookings

Should you wish to cancel a booking made using your gift voucher, then the cancellation terms for that particular voucher booking will apply.

If you cancel your booking within the permitted timings (usually 48 hours), your gift voucher will be re-instated to its full value and you will be eligible to use it for another booking. If you cancel your booking outside of the permitted timings (usually within 48 hours), we will consider your gift voucher redeemed and you will not be able to use it on another booking.

Limitation of liability

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the services we offer you. This does not affect your statutory rights as a consumer under the Consumer Rights Act 2015 or your cancellation rights under these terms. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time these terms were entered into, both we and you know it would happen. Nothing in these terms shall exclude or limit our liability for death or personal injury caused by our negligence or the negligence of our employees or agents. In the event that the Ommaroo Hotel breaches its contract with you, the Ommaroo Hotel shall be responsible only for refunding the cost of the gift voucher. The Ommaroo Hotel will not be liable to pay any other compensation or losses suffered by you as a consequence of the Ommaroo Hotel’s breach of contract.

Each of the paragraphs of these terms apply separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
